Terms and Conditions: Technical Assistance Program From Lighthouse PLCs, Inc. 


1. All rates are net unless negotiated in advance.

2. Service will be at prevailing rates in effect at time work is performed. Standby No discount is offered for "standby" time. Standby time is herein defined as non-productive periods where the engineer and/or technician are unable to perform their work due to circumstances beyond their control, such as but not limited to: waiting for appropriate union craftsmen or plant operations personnel; availability of machinery or facilities; accessibility due to dangerous or hazardous environments. It is the responsibility of the engineer and/or technician to notify the customer if the situation is found to exist. Further, the customer will be billed at the appropriate published rate for time spent at the job site. The customer may at its discretion, send the engineer and/or technician to their lodging in order to avoid unnecessary standby time with the understanding that irregardless of the actual time spent at the job site, a minimum of 8 hours per day will be billed at the prevailing published rate.

3. Required parts and materials will be priced in accordance with the Company's current published Conditions of Sale and pricing policy.

4. To schedule on-site service, or special service requirements such as 24 hour coverage, multiple engineer startups, off-shift scheduling etc. call 541/463/1496 with as much advance notice as possible.

5. If startup assistance is negotiated as part of an order, the customer is still responsible for travel and living expenses at standard rates.

6. TAP - Plan A: Consultation provided under this plan is intended to assist the customer with issues of and relating to Hitachi Programmable Logic Controllers and/or related software. This support is normally conducted via telephone, but may include other forms of communication and data transmission such as facsimile, Internet e-mail including file transfer, or video-conferencing in the form of (Microsoft)® NetMeeting. Live video-conferencing is also available, but must be negotiated separately and is not considered part of this plan. Time spent by the Applications Engineer in research, document preparation and dissemination or other related activities, is all considered part of this offering, and is chargeable per published rate. 

TAP - Plan B: In consideration of prevailing state electrical codes & regulations, organized labor contracts, and personnel/equipment liability issues, the work performed under the "Technical Assistance Program - Plan B" is intended as "Technical Consultation" is so far as furnishing expertise specific to Hitachi PLCs, and/or the related programming software (Hitachi or Actron). It is assumed and it is essential that the customer furnish sufficiently competent electrically trained and state certified personnel to perform any "hands-on'" wiring, equipment installation, testing, and/or interfacing with other system equipment. If the customer does not have personnel on its staff that meet these conditions, the customer must separately contract "outside" personnel, or institute "TAP - Plan C" as a separate component of this work.

TAP - Plan C: It is the customers responsibility to determine if work performed under "Technical Assistance Program - Plan C" will in any way conflict with prevailing state electrical codes & regulations, and/or organized labor contracts. If a conflict is determined to exist, the technician will in this instance forgo "hands-on" work and instead, provide guidance and suggestions to the customers provided craftsmen, with no discount from the published rate.

Lighthouse PLCs, Inc. does not represent itself as being knowledgeable about equipment other than Hitachi programmable Logic Controllers, nor does it assume responsibility for total system functionality or other system components.

7. Travel for "TAP - Plan B" is portal-to-portal from Eugene, Oregon.
Travel for "TAP - Plan C" is portal-to-portal from Elburn, Illinois.

8. The foregoing Terms and Conditions, and the related published rates are intended for work performed in the Continental United States. Travel and work performed outside of the Continental United States is to be negotiated per instance, and prior to any work commencement. "Pre-Paid Retainers" of up to 80% may be required in advance, with balance due within (1) week of job completion.

BEFORE WORK CAN COMMENCE UNDER ANY PORTION OF THE E.A.P., YOU MUST PRINT A COPY OF THESE TERMS AND CONDITIONS, SIGN, AND FAX THEM BACK TO 541.463.1497. BY SIGNING YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD AND HAVE ACCEPTED THE TERMS AND CONDITIONS.
